The homeless Hurricane Katrina survivor has filed a complaint against Fayette Wreckers in Georgia with the Better Business Bureau (BBB).

The complaint number is: 10608354

Complaint:

I am a victim of THEFT BY CONVERSION via the Fayetteville Police Department and Fayette Wreckers. (Case NO: 090909169; Ticket No: 1400 and 1408). My 1995 Ford Explorer along with all my belongings that survived Hurricane Katrina were stolen from me and sold via an AUCTION by Fayette Wreckers.

On 9/13/09, Officer Hartley, a Fayetteville Police Officer, had arrested me and called Fayette Wreckers to have my vehicle towed in my presence unjustly / without my authority. I told him not to do it! I was NOT in an ACCIDENT; I did not cause an ACCIDENT; I was NOT parked illegally; And my vehicle did not breakdown. Chris Taylor (Fayette Wreckers driver) had no rights to tow my vehicle to Fayette Wreckers.

"A police officer can not act as the Justice of the Peace." Op.Jud.Quals.Comm No.34, Aug 10, 1979

Anyway, after I was sentenced to jail for 120 days by Judge Michael Martin on May 25, 2010 pertaining to this case in the Fayetteville Muncipal Court, I wrote a letter to the Fayetteville Police Department on June 18, 2010 while in Fayette County Detention Facility regarding my truck. And on June 21, 2010, I had received a hand-carried letter from Major Kevin Gooding, Patrol Division Commander, at the Fayetteville Police Department.

The letter states that Fayette Wrecker had AUCTION my Ford Explorer and sold all my belongings on 3/12/10. KEEP IN MIND, MY CASE WAS NOT CLOSED UNTIL I WENT TO COURT ON 5/25/10. That was the day I was sentenced to jail for 120 days.

Now according to the letter I received from Major Kevin Gooding, Officer Hartley "falsified" the impoundment document. Officer Hartley also failed to fillout Part III-Impoundment Custody Data on the Fayetteville Police Department Vehicle Impoundment Record. Therefore NO HOLD was placed on the vehicle. Therefore, Fayette Wreckers had AUCTIONED off my vehicle and sold it along with my belongings.

Chief Justice Carol W. Hunstein-

Officially today, I am requesting via email 5.75 Million Dollars settlement for Georgia's financial hardship since arriving here after Hurricane Katrina in 2006.

You have received MANY complaints from me pertaining to my issues here in Georgia. This also includes:

* THEFT BY CONVERSION by Officer Hartley, a Fayetteville Police Officer in Fayetteville, Ga (He stole my truck with all of my possessions inside of it, and performed an illegal search of my vehicle);

* assault by Officer Threat and his supervisor , a Riverdale Police Officer. The nurse at the Clayton County Detention Center witness the bruising;

* and excessive force by Officer Thomas, a Clayton County Police Officer. He arrested me for distributing fliers about my homelessness in a legal area on Old Dixie Hwy and Holiday Drive.

I had filed my taxes as a homeless pan-handler in Georgia on 1/15/10. I owe the government $89.59 if my taxes were done correctly!

I have asked the Taskforce for the Homeless to sue the Clayton County Police Department and the City of Riverdale Police Department on the grounds of loss of income due to "JAIL TIME" served without a conviction as a homeless pan handler. I have yet to get a response from them.
