This group is about being proud of who we are its about government,social,community,politics and african american lives feel free to state your mind and tell it like it is it is about time for the black on black violence to stop and for us to become one strong voice instead of many its time to stop degrading are women and for are women to stop degrading themselves. There is a serious problem with black men and women of today and the problem is that we are LAZY %#&@$! hell we are teaching are kids the wrong things like making them think that the only way to make it is to play sports so they can get paid millions or to rap and show off the bling bling this has to stop we have to secure are future and to save are african race we are headed for destruction my people we have to teach are children to grow up to be lawyers and get to congress and start being apart of politics we need doctors, teachers, more students in college we need strong black brothas and sistas so stand speak loud

I am new to this group, and want to thank the New Black Panthers for Keeping it 100! As the mother of Kerry Baxter Senior, I am seeking support in having his Wrongful Conviction Overturned. We have a Facebook Website and Petition Circulating to educate the Public about his conviction. Kerry, an African American Male, was involved in an altercation in East Oakland California on March 30, 2001. He was thirty-one years old when approached by another African American Male, Jahmani Jones who was twenty-one years old. Kerry was in the Martinique Bar on MacArthur Blvd., and Maple Street. He and Jahmani were down the street from the Martinique, where Kerry was summoned by the younger man, and several of his friends. Kerry and Jahmani were engaged in a altercation, after Jahmani accused Kerry of telling people he shot Kerry's SUV back window out. Kerry was telling Jahmani his side of the story when Jahmani pulled out a gun and shot in Kerry's direction, missing him. Kerry pulled out a gun and shot Jahmani in the left foot and fearing for his life, he fled. Kerry later stated that he was trying to stop Jahmani from shooting at him, and not to hurt him. Jahmani ran towards MacArthur Blvd., and Kerry ran down Maple away from the Martinique towards, Georgia Street. It was not until later, that someone told Kerry a man had been shot standing in front of the Martinique Bar. Where Kerry and Jahmani were standing takes on importance because a Homicide Detective said that Kerry's one bullet ricocheted across the street (over two blocks away), and hit the bystander in the chest.

Jahmani Jones went to the Hospital and Kerry Left the scene. Anyone who knows the History of the Oakland Police Department knows why, no one stayed on the scene. The man who was hit, was Anthony Blake someone who Kerry had seen earlier in the bar, and who was also African American. Although the DA and Police testified that Blake had been hit in the Chest, the Coroner Report states that Blake was hit in the left Clavicle, and traveled downward, nicking his heart. He bled out on the sidewalk before the Ambulance or Police arrived. The depositions from witnesses state that Blake was hit in a drive by shooting. The witness described the car as a Cadillac that drove by and shot 4 rapid rounds. The Police claim to have picked up two bullet casings at the scene (meaning where Blake was shot). Kerry and Jahmani were down the street and it appears that there were two simultaneous shootings that night. There is no mention of the police even finding casings on Maple. At first the police went over Jahmani Jones, and even took a GSR Test and a Lie Detector Test (which they said he failed). When Kerry learned there was an All Points Bulletin out for him, describing him as armed and dangerous, his family arranged a peaceful surrender. Jahmani Jones turned from a suspect to a victim prior to the trial and all charges against him were dropped. He was given blanket immunity to testify against Kerry Baxter, when Brian Madeira, a White Homicide Detective, with a record of assaulting and abusing blacks, took over the case.

In the eyes of the system, Kerry made a major mistake when he refused to take a Plea to second degree murder. In other words he was trying to murder Jahmani and in the process killed Anthony Blake. Previously he had asked that he have a different Public Defender than Jahmani Jones, who was set to testify against him. The courts ignored the order. When they had the preliminary hearing a private attorney was introduced for Kerry. Jahmani Jones and the Homicide Detective perjured themselves, but the court would not allow sanctions. None of the witnesses were called to testify by the Defense or the DA, even though their testimony would have cleared Kerry. The Attorney, who represented Kerry was named Richard Hove, and he was a friend of the court. His father and the Judge presiding over Kerry's case, were both Judges in Alameda County Superior Court. It was, in fact, Hove who sought Kerry out while he was awaiting Trial. We did not know until after the trial that the entire time Hove was representing Kerry he was being disbarred by the California Bar Association. The Judge and DA knew Hoves' Status, and did not mention it nor deny him the right to represent Kerry. The Judge (Jeffrey Horner), also knew the victim, who had sat in on a Death Penalty case which he presided over. Horner was the same Judge who oversaw the case against the Knight Riders, Police who beat up and robbed young black men in West Oakland. Later, I would learn that Brian Madeira was one of the Policemen who terrorized young black males in West Oakland, although he was not charged as a Rider. Judge Horner over saw the case which resulted in a hung jury.

When Jury selection started Kerry was surprised how quickly all of the African American Jurors were struck. He was left with an all white jury, one that the DA could have hand picked. The trial was held in the Alameda County Superior Court in Oakland CA, a city that is at least 40% African American. When the trial started, Kerry was surprised that the Detective called him a Gang Member and a Drug Dealer. Kerry, had gotten in trouble as a young man but at 31 years old, he was employed as a Carpenter and a member of the Carpenter's Union. He was also a Journey Level Machinist and had worked for the Naval Hospital in Oakland. The fact is that although he had minor run ins with the law, Kerry always held a job.

During the trial Jahmani Jones perjured himself three times and the Court overruled the attorney's objection. Jahmani, under Blanket Immunity committed crimes in Oakland, including, Assault with a deadly weapon and Robbery. However, Jahmani Jones told the courts that he actually respected Kerry as an older man in the community. The fact is that neither Jahmani, nor Kerry would have been charged with the murder of Anthony Blake, had all of the witness testimony been entered. Because Kerry was accused of being a Gang Member, he was sent to High Desert Prison and kept on Lock-down most of the time he was there. It was not until 2011, that he was transferred to New Folsom, which is closer to where his family lives. He was then transferred to Corcoran and is now in Los Angeles County State Prison, in Lancaster California. The New Jim Crow, opened the dialogue for us to discuss what is going on with our JUST US System. As Kerry's mother, I am a one Person Army out to free my son and to overturn a system that treats us like Chattel.

I am unplugging myself from the system, to be part of the system is to be a SLAVE. Europeans are the INVADERS, and the original people of this land is still in BONDAGE. To be SAVE mean to be FREE, your BAPTISM did not make you free, OUR ANCESTOR did not prayed nor call on a EUROPEAN CHRIST!!!
